TeamViewer social media contest — conditions of participation
1. General
a. The Social Media Contest (hereinafter referred to as "Contest") will be administered by TeamViewer Germany GmbH, Bahnhofsplatz 2, 73033 Goeppingen, Germany (hereinafter jointly referred to as "TeamViewer").
b. At the Contest, only persons who are at least eighteen (18) years of age at the time of entry ("Participant") may take part.
c. Participation in the Contest is voluntary and free of charge.
d. By participating, Participant agrees to be bound by these Terms and Conditions, which are final and binding in all matters relating to the Contest. Winning the prize (as defined below) is contingent upon the satisfaction of all requirements set forth herein.
2. Participation Period
The participation period for the Contest on Monday, June 24th 2024 at 00.01 am CEST and ends on Sunday, July 7th, 2024 at 23.59 pm CEST ("Participation Period").
3. Conditions of participation
a. During the Participation Period, the Contest will be accessible via the Social Media pages of TeamViewer on Facebook, lnstagram, and Linkedln. Participants must describe within the comment section of the corresponding post by TeamViewer how they, in their role as system administrator, saved someone else's day by fixing their IT problem.
b. Each Participant may only participate once. Any attempt by Participant to obtain more than one entry by using multiple/different email addresses, identities, registrations and logins or other methods will be void. TeamViewer reserves the right to disqualify Participants at its sole discretion. The use of an automated system to participate is prohibited and will also result in disqualification.
c. By participating, Participant agrees that, in the event of winning, TeamViewer may report on the participation in the Contest with the comment, name, and photo of winner, including the publication of photos on the social media channels and other channels of TeamViewer.
d. In the event of a dispute, the authorized account holder of the Social Media account used to enter the Contest will be deemed to be a Participant. The winner may be required to provide proof that he/she is an authorized Social Media account holder.
4. Contest, notification of winner
a. After the end of the Participation Period, the TeamViewer will select the winners of the Contest on July 8th, 2024. The comment with the most likes will be selected.
b. One (1) winner per Social Media platform will be selected.
c. After selecting the winner, winners of the Contest will be notified of the prize via private message to their Social Media account.
5. Prize
a. The prize is to be spotlighted on the Social Media channels of TeamViewer.
b. If a winner is disqualified for any reason, TeamViewer will award the prize to an alternate winner by selecting one from all remaining comments by number of likes. Sections 5.a. to 5.c. shall apply mutatis mutandis. Only three (3) substitute awards will be held, after which the prize will no longer be awarded.
c. Prizes are not subject to substitution or replacement. Prizes are non-exchangeable, non-transferable, cannot be sold and cannot be exchanged for cash or other prizes. TeamViewer reserves the right to substitute the prize with another prize of similar value if the originally offered prize is not available.
6. Privacy
a. Participant must use Social Media as described in section 3 to participate in the Contest.
b. TeamViewer uses Participants' Social Media account to notify the respective winner via private message and inform them about the implementation of the prize.
c. Personal data will only be passed on to the extent required and permitted by law or to the extent that the participant has consented to the disclosure. If and to the extent that the organizer uses the help of third parties to carry out the Contest and/or the Contest (e.g. IT service providers), the contractual relationships are subject to the relevant data protection regulations.
d. Participation in the Contest without providing the required personal data is not possible.

7. Limitation
a. TeamViewer is liable according to the statutory provisions if TeamViewer has acted intentionally or grossly negligently. In cases of simple or slight negligence, TeamViewer is liable — subject to milder liability standards according to the law (e.g. Care in own affairs, ddiligentia quam in suis) — only:
(a) damage resulting from death, injury to health or personal injury; or
(b) if this negligence violates an essential contractual obligation (cardinal obligation, an obligation whose fulfilment makes the proper execution of the Contest possible in the first place and on the observance of which the participant could rely), whereby the liability is limited to typical damages foreseeable at the time of announcement of these conditions of participation.
b. The exclusions and limitations of liability in Section 7.a. also apply to damages caused by persons for whom the TeamViewer is liable under the statutory provisions. The exclusions and limitations of liability in Section 7.a. shall not apply if TeamViewer has fraudulently concealed a defect or if the Product Liability Act prescribes mandatory liability which cannot be excluded.
c. Participant agrees to fully release and hold the operator of the respective Social Media platform harmless from liability. Participant acknowledges that the Contest is in no way sponsored, endorsed, administered by, or associated with the operator of the respective Social Media platform.
8. Other
a. Participation in the Contest is subject to the law of the Federal Republic of Germany. This law shall apply to the exclusion of the provisions of the United Nations Convention on Contracts for the Sale of Goods, including its amendments, and to the exclusion of the principles of conflict of laws. The exclusive place of jurisdiction is Stuttgart, Germany.
b. Should one of the provisions contained herein be or become invalid, this shall not affect the validity of the remaining conditions of participation.
c. TeamViewer reserves (i) the right to cancel the Contest at any time and without notice at its sole discretion; (ii) the right to cancel, suspend and/or modify the Contest or any part thereof if fraud, technical error, human error or other factors affect the integrity or proper functioning of the Contests, as determined by TeamViewer in its sole discretion; (iii) the right, in its sole discretion, to disqualify any person who tampers with the entry process or the course of the Contest, or violates the terms and conditions of this or any other Promotion or behaves in an unsportsmanlike or disruptive manner. Any attempt by any person to intentionally undermine the lawful operation of the Contests may constitute a violation of criminal and civil laws. Should such an attempt be made, the TeamViewer reserves the right to seek damages from such person to the fullest extent permitted by law. The failure of TeamViewer to enforce any provision of these Terms and Conditions shall not constitute a waiver of such provision.
d. TeamViewer also reserves the right to change or supplement these terms and conditions. Changes to these conditions of participation will be communicated in advance by e-mail to the last e-mail address provided. They shall be deemed approved if they are not objected to within one month of receipt of the notification. This will be pointed out again in the notification.
e. Legal recourse is excluded.
